Russian legislation on counteracting terrorism
Law on Combating Terrorismdefines terrorism as the commission of an explosion, arson or other actions that create a danger of loss of life, significant property damage or the occurrence of other socially dangerous consequences, if these actions are committed with the aim of violating public safety, intimidating the population or influencing decision-making by government bodies, as well as the threat of committing such actions for the same purposes. It is not yet possible to completely eradicate terrorism, but to counter terrorism and extremism— it is real. This is legislatively enshrined in federal documents of the Russian Federation.
Federal Law on Combating Terrorism
In 2006, the Federal Law on Combating Terrorism was adopted. According to this document, counteraction is based on the principles of:
ensuring and protecting the fundamental rights and freedoms of man and citizen; legality; priority of protecting the rights and legitimate interests of persons exposed to terrorist threat; inevitability of punishment for terrorist activity; systematic and comprehensive use of political, information and propaganda, socio-economic, legal, special and other measures to counter terrorism; cooperation of the state with public and religious associations, international and other organizations, citizens in countering terrorism; unity of command in the management of the forces and means involved in counter-terrorism operations; a combination of overt and covert methods of countering terrorism; confidentiality of information on special means, technical methods, tactics for implementing counter-terrorism measures, as well as on the composition of their participants; inadmissibility of political concessions to terrorists; minimization and (or) elimination of the consequences of terrorism; proportionality of counter-terrorism measures to the degree of terrorist threat. Federal Law on Counteracting Terrorismprovides the following definition of this concept: counter-terrorism — the activities of state authorities and local governments to: prevent terrorism, including identifying and subsequently eliminating the causes and conditions that contribute to the commission of terrorist acts (prevention of terrorism); identifying, preventing, suppressing, exposing and investigating a terrorist act (counter-terrorism); minimizing and (or) eliminating the consequences of terrorism.
Counter-terrorism measures imply the following
The President of the Russian Federation defines the main counter-terrorism measuresand directions of state policy in the field of countering terrorism; competence of federal executive bodies, the management of which it exercises, in the fight against terrorism.
Counter-terrorism measures by the Government of the Russian Federation stipulate that the Government determines the competence of federal executive bodies, the management of which it exercises, in the field of countering terrorism; organizes the development and implementation of measures to prevent terrorism and minimize and (or) eliminate the consequences of terrorism; organizes the provision of the activities of federal executive bodies, executive bodies of the constituent entities of the Russian Federation and local governments in countering terrorism with the necessary forces, means and resources.
Federal executive bodies, state authorities of the constituent entities of the Russian Federation and local governments carry out counter-terrorism and extremism within the limits of their authority.
