«On approval of special conditions for the acquisition of radio-electronic equipment and high-frequency devices»
In pursuance of the Federal Law «On Communications» (amendment of the legislation of the Russian Federation, 1995, No. 8, Article 600), the Government decrees:
- To approve the attached special conditions for the acquisition of radio-electronic equipment and high-frequency devices.
- The Ministry of Communications of the Russian Federation shall develop and submit to the Government of the Russian Federation in December 1996, in accordance with the established procedure, a draft procedure for registering communications equipment, including those used for television and radio broadcasting purposes, and other technical equipment that are sources of electromagnetic radiation.

SPECIAL CONDITIONS
for the acquisition of radio-electronic equipment and high-frequency devices.
- These special conditions for the acquisition of radio-electronic equipment and high-frequency devices (hereinafter referred to as the «conditions») have been developed in accordance with the Federal Law «On Communications» and establish the specifics of the acquisition of radio-electronic equipment and high-frequency devices on the territory of the Russian Federation.
- Radio electronic means are technical means consisting of one or more radio transmitting or radio receiving devices or their combination and auxiliary equipment intended for the transmission and reception of radio waves. Radio electronic means include radio stations, radio telephones, radio navigation systems, radio determination, cable television systems and other devices, the operation of which uses electromagnetic oscillations with frequencies above 9 kHz. High-frequency devices are equipment or devices intended for the generation and local use of radio frequency energy for industrial, scientific, medical, household and other purposes, with the exception of use in the field of telecommunications. These terms and conditions do not apply to the purchase of:
- radio receiving devices intended for individual reception of television programs or radio broadcasts
- household appliances that do not contain radio emitting devices
- children's radio communication devices and radio-controlled toys operating in the frequency band 26957-27283 kHz with a radiation power of no more than 10 mW.
- cordless telephones (radio telephones) operating in the frequency bands 814-815 MHz and 904-905 MHz with a radiation power of no more than 10 mW.
- electronic equipment and high-frequency devices for the needs of the Ministry of Defense of the Russian Federation, the Ministry of Internal Affairs of the Russian Federation, the Federal Security Service of the Russian Federation, the Federal Agency for Government Communications and Information under the President of the Russian Federation, the Federal Guard Service of the Russian Federation, the Presidential Security Service of the Russian Federation, the Foreign Intelligence Service of the Russian Federation, the Federal Tax Police Service of the Russian Federation, as well as for the needs of the Federal Aviation Service of Russia for the purpose of organizing air communications in terms of electronic equipment and high-quality devices operating in the frequency bands of the air mobility service and the air radio navigation service.
In cases of sale in the prescribed manner of electronic equipment and high-quality devices by the said federal executive bodies to other legal entities or individuals, these conditions shall apply to them.
- The acquisition of radio-electronic equipment and high-quality devices in the territory of the Russian Federation is carried out on the basis of permits issued by the Main Directorate of State Supervision of Communications in the Russian Federation or its territorial bodies. Permission to acquire radio-electronic equipment and high-quality devices is required regardless of the purpose of their acquisition (direct use in radio communication networks, television and radio broadcasting, their subsequent sale).
- The procedure for issuing permits for the acquisition of radio-electronic equipment and high-frequency devices is established by the Main Directorate of State Supervision of Communications in the Russian Federation.
- Radio-electronic equipment and high-frequency devices on the territory of the Russian Federation are sold only to buyers who have permission to purchase them. In the event of the purchase of radio-electronic equipment and high-frequency devices by way of succession (inheritance), the successor (heir) shall inform the Main Directorate of State Supervision of Communications in the Russian Federation or its territorial body that issued the permit for the purchase of the said equipment and devices, of such purchase.
- The sale of radio-electronic equipment and high-frequency devices to citizens purchasing them for personal (household) needs is carried out in accordance with the Rules for the Sale of Certain Goods, approved by Resolution of the Council of Ministers of the Government of the Russian Federation dated October 8, 1993 No. 995 (annexation of acts of the President and the Government of the Russian Federation, 1993, No. 43, Art. 4092), and taking into account the requirements of these terms and conditions.
