REGULATION

«On the Interdepartmental Commission of the Security Council of the Russian Federation for the Protection of Citizens' Rights and Public Safety, the Fight against Crime and Corruption»

I. General Provisions

  1. The Interdepartmental Commission of the Security Council of the Russian Federation for the Protection of Citizens' Rights and Public Safety, and the Fight against Crime and Corruption (hereinafter referred to as the «Commission») was established in accordance with the Law of the Russian Federation «On Security» and the Regulation on the Security Council of the Russian Federation, approved by Decree of the President of the Russian Federation of July 10, 1996 N 1024 «Questions of the Security Council of the Russian Federation».
  1. The Commission was created for the purpose of implementing the tasks assigned to the Security Council of the Russian Federation (hereinafter referred to as the «Security Council») in the field of ensuring the security of the individual, society and the state from criminal and other unlawful acts.
  1. The legal basis for the activities of the Commission are the Constitution of the Russian Federation, federal laws, decrees and orders of the President of the Russian Federation, the Regulation on the Security Council of the Russian Federation, and this Regulation.

II. Functions of the Commission

  1. The following functions are assigned to the Commission:

development of the main directions of the strategy in the field of ensuring the protection of citizens' rights, public safety, and the fight against crime and corruption in the Russian Federation;

preparation of proposals for the Security Council on the development and implementation of the main directions of state policy in the field of ensuring the security of the individual, society, and the state from criminal and other illegal actions;

assessment of the effectiveness of the system for ensuring the protection of citizens from criminal and other illegal actions, preparation of proposals for its improvement;

analysis and forecasting of the state of crime and other criminal phenomena in order to ensure public safety;

analysis of internal and external threats to the vital interests of society, its material and spiritual values;

preparation of proposals for the Security Council on the development of draft regulatory legal acts aimed at ensuring the security of the individual, society and the state from criminal and other unlawful acts;

consideration in the established manner of draft federal target programs aimed at combating crime and ensuring public safety, assessment of their effectiveness, preparation of relevant proposals;

hearing, on behalf of the President of the Russian Federation, information from law enforcement officials on the state of the fight against crime and ensuring public safety;

summarizing the practice of combating corruption in federal government bodies and making proposals for the prevention of this type of illegal action;

studying foreign experience in combating crime and corruption, preparing proposals for its use in the activities of law enforcement agencies of the Russian Federation.

III. Procedure for the formation and activities of the Commission

  1. The Commission shall be created, reorganized and abolished by decree of the President of the Russian Federation. The Regulation on the Commission shall be approved by the President of the Russian Federation upon the submission of the Secretary of the Security Council of the Russian Federation (hereinafter referred to as the Secretary of the Security Council).

The Commission shall include heads of federal government bodies and/or their deputies (including by agreement). If necessary, other persons may be included in its composition.

  1. The Chairman of the Commission shall be appointed by the President of the Russian Federation. The Chairman of the Commission shall have one deputy.

The Chairman of the Commission and other persons included in the Commission shall carry out their activities on a voluntary basis.

  1. In order to carry out its functions, the Commission has the right to:

request and receive, in the established manner, the necessary materials and information from federal government bodies, government bodies of the constituent entities of the Russian Federation, as well as from institutions, organizations and officials;

use, in the established manner, the databases of the Administration of the President of the Russian Federation and federal government bodies;

use state, including government, communication and communications systems;

engage scientists and specialists in the established manner to carry out certain work;

interact in the established manner with the Office of the Council of the Federation of the Federal Assembly of the Russian Federation, the Office of the State Duma of the Federal Assembly of the Russian Federation, the Office of the Government of the Russian Federation, the offices of the Constitutional Court of the Russian Federation, the Supreme Court of the Russian Federation, the Supreme Arbitration Court of the Russian Federation, the Prosecutor General's Office of the Russian Federation, with independent divisions of the Administration of the President of the Russian Federation, with federal executive bodies, state authorities of the constituent entities of the Russian Federation, as well as with institutions, organizations and officials on issues within its competence;

prepare proposals for concluding, in accordance with the established procedure, contracts with research organizations, institutions and specialists for the performance of work in the field of ensuring the protection of citizens' rights, public safety, and the fight against crime and corruption;

summarize and submit to the Security Council information on issues within its competence;

determine the agenda of the Commission's meetings and compile lists of persons invited to them.

  1. The work of the Commission is carried out according to plans approved by the Secretary of the Security Council.
  1. Meetings of the Commission are held at least once a month. If necessary, extraordinary meetings of the Commission may be held.

The presence of members of the Commission at the meeting is mandatory. They do not have the right to delegate their powers to other persons. In the absence of a member of the Commission at the meeting, he has the right to state his opinion on the issues under consideration in writing.

  1. The members of the Commission have equal rights when discussing the issues under consideration at the meeting. The decisions of the Commission are taken by a majority of votes of the members of the Commission present at the meeting and are recorded in a protocol signed by the Chairman of the Commission. In case of disagreement with the decision taken, a member of the Commission has the right to state his opinion in writing, which must be attached to the minutes of the meeting.

The decisions of the Commission approved by the Secretary of the Security Council are subject to mandatory review by the federal executive bodies.

  1. The information, logistical and other support for the activities of the Commission is carried out by the apparatus of the Security Council, as well as, where necessary, the federal government bodies whose representatives are members of the Commission.
