«On federal bodies of government communications and information»
This Law defines the purpose, legal basis, principles of organization and main areas of activity, system, duties and rights, powers and means of federal government communications and information agencies, as well as the types and procedure for monitoring and supervision of their activities.
SECTION 1
GENERAL PROVISIONS
Article 1. Purpose of federal government communications and information agencies
Federal agencies of government communications and information are an integral part of the security forces of the Russian Federation and are part of the system of federal executive authorities.
Federal bodies of government communications and information provide the highest bodies of state power of the Russian Federation, bodies of state power of the subjects of the Russian Federation, central bodies of federal executive power, the Security Council of the Russian Federation (hereinafter referred to as «government bodies»), organizations, enterprises, institutions with special types of communications and information, and also organize the activities of central bodies of federal executive power, organizations, enterprises, institutions to ensure cryptographic and engineering security of encrypted communications in the Russian Federation and its institutions abroad, and exercise state control over this activity.
Federal agencies of government communications and information, within the limits of their competence, participate with the Main Directorate of Security of the Russian Federation in organizing and ensuring presidential communications.
Article 2. Legal basis for the activities of federal agencies of government communications and information
The legal basis for the activities of federal government communications and information agencies is the Constitution of the Russian Federation, the Laws of the Russian Federation «On Security», «On Defense», «On Foreign Intelligence», this law, other laws of the Russian Federation, as well as regulatory acts of the President of the Russian Federation and the Government of the Russian Federation adopted in accordance with them.
The activities of federal government communications and information agencies are carried out in accordance with international treaties and agreements concluded or recognized by the Russian Federation.
Federal government communications and information agencies issue acts within their competence in accordance with the legislation of the Russian Federation.
The creation and activities of political parties and organizations in federal government communications and information agencies are not permitted.
Article 3. Main areas of activity of federal government communications and information agencies
The main areas of activity of federal government communications and information agencies are:
organization and provision of operation, security, development and improvement of government communications, other types of special communications and systems of special information for government agencies;
ensuring, within the limits of its competence, the safety of state secrets; organization and provision of cryptographic and engineering security of encrypted communications in the Russian Federation and its institutions abroad;
organization and conduct of foreign intelligence activities in the sphere of encrypted, classified and other types of special communications using radio-electronic means and methods;
providing the highest bodies of state power of the Russian Federation, the central bodies of the federal executive power, the Security Council of the Russian Federation with reliable and independent from other sources special information (materials of foreign intelligence activities, information on maintaining management of the national economy in a special period, wartime and emergency situations, economic information for mobilization purposes, information of socio-economic monitoring), necessary for them to make decisions in the field of security, defense, economics, science and technology, international relations, ecology, as well as mobilization readiness.
Article 4. Principles of organizing the activities of federal bodies of government communications and information
1. The activities of federal bodies of government communications and information are based on the principles of:
legality;
respect for the rights and freedoms of man and citizen;
safety of state secrets;
controllability and accountability to the highest bodies of state power of the Russian Federation.
2. Federal bodies of government communications and information operate on the basis of:
unity of the system of federal bodies of government communications and information;
centralization of management of the system of federal bodies of government communications and information;
combinations of linear, territorial and object principles of organizing the activities of federal government communications and information agencies.
SECTION II
SYSTEM OF FEDERAL GOVERNMENT COMMUNICATION AND INFORMATION AGENCIES
Article 5. Construction of the system of federal government communications and information agencies
The unified system of federal government communications and information agencies consists of:
Federal Agency for Government Communications and Information under the President of the Russian Federation (hereinafter referred to as the Federal Agency);
government communications and information agencies (government communications centers, information and analytical agencies) in the constituent entities of the Russian Federation;
troops;
educational institutions, research organizations, enterprises.
Federal agencies of government communications and information create structural divisions for financial, logistical, engineering and construction, medical and other support of their activities.
The Academy of Cryptography of the Russian Federation operates under the Federal Agency.
Article 6. Federal Agency for Government Communications and Information under the President of the Russian Federation
1. The Federal Agency is under the direct jurisdiction of the President of the Russian Federation and is the central body of the federal executive power responsible for issues of organizing and ensuring government communications, other types of special communications for government agencies, organizing and ensuring cryptographic and engineering security of encrypted communications, organizing and conducting intelligence activities in the field of encrypted, classified and other types of special communications, special information support for the highest bodies of state power of the Russian Federation, and central bodies of the federal executive power. The Federal Agency is headed and supervised by the Director General.
The divisions and units of the Federal Agency's radio intelligence, ensuring the organization and conduct of intelligence activities in the field of encrypted, classified and other types of special communications, form the foreign intelligence body of the Federal Agency, headed by the Director General and acting in accordance with the Law of the Russian Federation «On Foreign Intelligence».
2. The Federal Agency carries out state regulation and intersectoral coordination on issues within its jurisdiction.
Regulatory acts and orders of the Federal Agency in terms of the organization, ensuring the functioning and security of government encrypted and other types of special communications are mandatory for execution by government agencies, as well as organizations, enterprises, institutions, regardless of their departmental affiliation and organizational and legal forms, taking into account mutually agreed requirements of departmental instructions on the organization and ensuring the security of encrypted communications.
3. The tasks, functions, organization and structure of the Federal Agency are determined by the Regulation on the Federal Agency for Government Communications and Information under the President of the Russian Federation, approved by the President of the Russian Federation in agreement with the Committee of the Supreme Council of the Russian Federation on Defense and Security.
4. The Federal Agency organizes, manages and directly carries out work in the areas of activity of federal government communications and information agencies, issues orders, directions, regulations, instructions and other regulatory acts that are mandatory for execution in the system of federal government communications and information agencies.
Article 7. Government communications and information agencies in the constituent entities of the Russian Federation
Government communications and information agencies in the constituent entities of the Russian Federation are part of the system of government administration bodies and exercise leadership in the relevant territory in the area of organizing and providing government communications, other types of special communications and information, and the collection and transmission of economic information in the interests of government bodies; within the limits of their competence, they directly carry out work in the main areas of activity of federal government communications and information agencies, organize, coordinate, and control the activities of their subordinate units, and are responsible for providing government bodies with special types of communications and information.
The organization of the activities of government communications and information agencies in the constituent entities of the Russian Federation is determined by the relevant provisions approved by the Director General of the Federal Agency in agreement with the highest officials of the constituent entities of the Russian Federation.
Article 8. Troops of the Federal Agency for Government Communications and Information under the President of the Russian Federation
The troops of the Federal Agency for Government Communications and Information under the President of the Russian Federation include government communications troops, radio intelligence units, and engineering and construction units that are created, maintained, and used, including outside the Russian Federation, in accordance with the legislation of the Russian Federation.
The commander of the troops of the Federal Agency is the general director.
Article 9. Interaction of federal government communications and information agencies with other government agencies and organizations
Federal agencies of government communications and information solve the tasks assigned to them in cooperation with the Ministry of Security of the Russian Federation, the Ministry of Defense of the Russian Federation, the Ministry of Foreign Affairs of the Russian Federation, the Ministry of Internal Affairs of the Russian Federation, the Ministry of Communications of the Russian Federation, the Foreign Intelligence Service of the Russian Federation, the Main Directorate of Security of the Russian Federation, the State Technical Commission under the President of the Russian Federation, and other state agencies and organizations.
State bodies are obliged to provide federal bodies of government communications and information with assistance in their activities to ensure the functioning of government communications, other types of special communications, the preservation of state secrets and special information support for the highest bodies of state power of the Russian Federation, central bodies of federal executive power.
SECTION III
RESPONSIBILITIES AND RIGHTS OF FEDERAL BODIES OF GOVERNMENT COMMUNICATIONS AND INFORMATION
Article 10. Responsibilities of federal bodies of government communications and information
Federal bodies of government communications and information are obliged to:
a) provide government communications in places of permanent or temporary residence of the President of the Russian Federation, the Chairman of the Supreme Council of the Russian Federation, the Chairman of the Government of the Russian Federation, the Chairman of the Constitutional Court of the Russian Federation, the Chairman of the Supreme Court of the Russian Federation and the Chairman of the Supreme Arbitration Court of the Russian Federation;
b) participate, within the limits of their competence, with the Main Directorate of Security of the Russian Federation in organizing and ensuring presidential communications, while maintaining its unity, reliability, security and efficiency;
c) provide government communications and other types of special communications to state bodies, the highest military leadership and commands of the Armed Forces of the Russian Federation, as well as organizations, enterprises, banks and other institutions. The principles of organization and procedure for using government communications are determined by the Regulation on Government Communications of the Russian Federation, approved by the President of the Russian Federation in agreement with the heads of the highest legislative and judicial bodies of the Russian Federation;
d) carry out intelligence activities in the sphere of encrypted, classified and other types of special communications;
d) provide the highest bodies of state power of the Russian Federation, the central bodies of federal executive power, the Security Council of the Russian Federation with special information necessary for them to make decisions in the areas of security, defense, economics, science and technology, international relations, ecology, and mobilization readiness;
e) coordinate activities on security issues (including at the stages of creation, development, and operation) of information and analytical networks, complexes of technical means of databases of the highest bodies of state power and the Security Council of the Russian Federation;
g) ensure the security of government communications of the Russian Federation;
h) coordinate, free of charge, in the interests of ensuring the preservation of state and other secrets protected by law, the activities of organizations, enterprises, institutions, regardless of their departmental affiliation and form of ownership, in the field of development, production and supply of encryption tools and special communications equipment;
i) coordinate the activities of central federal executive bodies, organizations, enterprises, banks and other institutions to ensure cryptographic and engineering security of encrypted communications in the Russian Federation and its institutions abroad, and supply them with key documents;
k) participate in ensuring the protection of technical means for processing, storing and transmitting classified information in institutions located abroad of the Russian Federation from its leakage through technical channels;
l) ensure, together with the relevant services of the highest bodies of state power of the Russian Federation, the protection of particularly important premises of these bodies and the technical equipment located therein from the leakage of classified information through technical channels;
b) organize the activities of central federal executive bodies, organizations, enterprises, banks and other institutions to identify electronic devices for intercepting information in technical means and ensure the identification of devices for intercepting information in particularly important premises and technical means intended for use in government bodies of the Russian Federation;
n) develop and manufacture specialized technical means and systems to ensure the main areas of its activities;
o) ensure in its activities the safety of state and other secrets specially protected by law;
p) ensure the readiness of government communications and special information systems for operation in wartime and emergency situations; maintain technical means of alerting government agencies in constant combat readiness;
p) maintain and ensure their mobilization readiness.
Article 11. Rights of federal government communications and information agencies
Federal government communications and information agencies have the right:
a) issue regulations and orders regarding the organization, operation and security of government, encrypted and other types of special communications, as well as the security of information and analytical networks, complexes of technical means of databases of the highest bodies of state power and the Security Council of the Russian Federation;
b) access in the established manner to communications facilities, regardless of their departmental affiliation and form of ownership, in which lines pass or government communications facilities are located, and also perform work at such facilities related to solving the tasks assigned to the federal bodies of government communications and information;
c) to receive, on a priority basis, from the relevant bodies responsible for the distribution and assignment of radio frequencies, radio frequency bands for their exclusive use by government communications radio equipment throughout the territory of the Russian Federation, and also to conclude contracts for the lease of communication lines and channels to ensure the activities of federal government communications and information bodies within the limits of allocated funds;
d) impose restrictions, in agreement with the relevant authorities responsible for the distribution and assignment of radio frequencies, on the use of radio electronic equipment for any purpose if they operate in violation of the requirements of regulatory acts and create radio interference with the operation of government communications equipment;
d) involve the forces and communications equipment of the Armed Forces of the Russian Federation (in agreement with the General Staff of the Armed Forces of the Russian Federation), central federal executive authorities to provide special communications in emergency situations;
e) charge a fee for the use of government communications and other types of special communications and distribute the funds received in accordance with the procedure established by the President of the Russian Federation,
The Supreme Council of the Russian Federation and the Government of the Russian Federation; payment for government and other types of special communications services is made at rates agreed upon with the Ministry of Finance of the Russian Federation;
g) carry out intelligence activities in the sphere of encrypted, classified and other types of special communications from the territory of the Russian Federation and beyond its borders using radio-electronic means and methods;
z) provide information materials of the foreign intelligence agency of the Federal Agency to the highest bodies of state power and the Security Council of the Russian Federation in accordance with the procedure approved by the President of the Russian Federation and the Chairman of the Supreme Council of the Russian Federation;
i) request and receive free of charge from the central bodies of the federal executive authority, state administration bodies of the constituent entities of the Russian Federation, state organizations, enterprises, institutions located on the territory of the Russian Federation, regardless of their departmental affiliation, information in accordance with the approved lists of indicators and the regulations for their submission and the instructions of the President of the Russian Federation or the Chairman of the Government of the Russian Federation;
k) determine the procedure for the development, production, sale, operation of encryption tools, as well as the provision of services in the field of information encryption in the Russian Federation; carry out, within the limits of its competence, licensing and certification of these types of activities, goods and services;
l) determine the procedure and ensure the issuance of licenses for the export and import of encryption tools and regulatory and technical documentation for their production and use; participate in determining the procedure and ensuring the issuance of licenses for the export and import of secure technical means of transmitting, processing and storing classified information;
m) carry out licensing and certification of telecommunications systems and complexes of the highest bodies of state power of the Russian Federation, as well as closed systems and complexes of telecommunications of bodies of state power of the constituent entities of the Russian Federation, central bodies of the federal executive power, organizations, enterprises, banks and other institutions located on the territory of the Russian Federation, regardless of their departmental affiliation and form of ownership;
n) exercise state control over the state of cryptographic and engineering-technical security of encrypted communications in government bodies of the constituent entities of the Russian Federation, in central federal executive bodies, in organizations, enterprises, banks and other institutions regardless of their departmental affiliation, as well as secret encryption work in institutions located outside the Russian Federation (except for secret office work in foreign offices of the Foreign Intelligence Service of the Russian Federation);
o) participate in determining the procedure for the development, production, sale and operation of technical means of processing, storing and transmitting classified information intended for use in institutions located outside the Russian Federation;
p) participate in the development of regulations on the implementation and control of measures to protect technical means of processing, storing and transmitting classified information at the places of their operation in institutions located outside the Russian Federation;
p) determine the procedure for carrying out work in the Russian Federation to identify electronic devices for intercepting information in technical means; carry out licensing of activities to identify electronic devices for intercepting information in technical means and premises of government agencies;
c) monitor the implementation of recommendations to eliminate possible technical channels for leakage of classified information from particularly important premises of the highest bodies of state power of the Russian Federation; monitor the security of technical means and facilities of the central bodies of federal executive power, the protection of which falls within the competence of the Federal Agency;
t) maintain contacts and cooperate with the relevant services of foreign states on issues of ensuring government international communications, intelligence activities in the field of encrypted, classified and other types of special communications, information protection, organization of encrypted communications and supply of encryption tools;
u) conduct research, development, construction and production work independently and under contracts with organizations and enterprises;
f) issue recommendations in accordance with the legislation of the Russian Federation on applications for inventions, utility models and industrial designs in the field of encryption tools, intelligence activities in the field of encrypted, classified and other types of special communications, as well as within the limits of its competence on issues of protecting premises and technical means from information leakage;
x) to permit its employees who are military personnel to store and carry service weapons and special equipment; to ensure the protection of facilities, buildings and structures by security units, and, where necessary, with the involvement of units of the Federal Agency or the Armed Forces of the Russian Federation (subject to agreement with the local command of the Armed Forces of the Russian Federation), using available technical means; to organize the protection and escort of especially important and top secret items, cargo and documents; while at the same time, to carry out the use of physical force, special equipment, and service weapons by employees in the manner prescribed by the general military regulations of the Armed Forces of the Russian Federation;
c) to create, in the manner established by the legislation of the Russian Federation, organizational structures (divisions and organizations) necessary for solving the tasks assigned to the federal government communications and information agencies;
w) to lease or acquire premises, buildings and other real estate necessary for solving the assigned tasks on the territory of the Russian Federation and beyond its borders;
w) provide assistance on a contractual basis to organizations, enterprises, institutions, regardless of their form of ownership, in the development and implementation of measures to protect commercial secrets using technical means, if this does not contradict the objectives and principles of the activities of federal government communications and information agencies.
SECTION IV
POWERS AND MEANS OF FEDERAL GOVERNMENT COMMUNICATIONS AND INFORMATION AGENCIES
Article 12. Employees of federal government communications and information agencies
1. Employees of federal government communications and information agencies are military personnel, civil servants and workers.
The total number of employees of federal government communications and information agencies is determined by the President of the Russian Federation.
2. Citizens of the Russian Federation who are capable of performing the tasks assigned to these bodies based on their personal, moral, business and professional qualities, education and health condition are accepted for service in federal government communications and information agencies.
Recruitment of troops with military personnel is carried out on a voluntary basis — under contracts, as well as on the basis of conscription of citizens of the Russian Federation for military service in the manner established by the legislation of the Russian Federation.
3. Military personnel of federal government communications and information agencies perform military service on the basis of the legislation of the Russian Federation, military regulations, other normative acts and provisions governing military service. They and their family members enjoy the rights and benefits granted to military personnel of the Armed Forces of the Russian Federation and their family members.
Military personnel of federal government communications and information agencies discharged from military service are enrolled in the reserve of the Ministry of Security of the Russian Federation or the Ministry of Defense of the Russian Federation in accordance with the legislation of the Russian Federation.
4. The labor activities of employees and workers of federal government communications and information agencies are regulated by the legislation of the Russian Federation on labor and on civil service, as well as by regulatory acts of the Federal Agency issued in accordance with them.
5. The duties and rights of specific categories of employees of federal government communications and information agencies shall be determined by this Law, other laws of the Russian Federation, decrees of the President of the Russian Federation and regulatory acts of the Government of the Russian Federation, as well as regulatory acts of the Federal Agency issued in accordance with them.
6. Employees of federal government communications and information agencies may be awarded the badge «Honorary Employee of the Federal Government Communications and Information Agency». The grounds and procedure for nomination for award of the said badge shall be determined by the Director General of the Federal Agency.
Article 13. Legal status of employees of federal government communications and information agencies
1. Employees of federal government communications and information agencies are protected by the state when performing their official duties. No one, except officials expressly authorized to do so by law, has the right to interfere with their official activities.
The demands of employees of federal government communications and information agencies, presented within the limits of their competence in the performance of their official duties, are mandatory for execution by state bodies, organizations, enterprises, institutions of the Russian Federation.
2. Protection from encroachment on the life and health, honor and dignity, as well as on the property of an employee of a federal government communications and information agency and members of his family in the performance of his official duties is carried out in accordance with the legislation of the Russian Federation.
3. It is not permitted to bring in or subject an employee of a federal government communications and information agency to administrative detention, or to search his belongings, personal or used transport while he is performing his official duties without the participation of a representative of this agency or without the sanction of the prosecutor.
4. Upon receipt from anyone of an order or instruction that is contrary to the legislation of the Russian Federation, an employee of the federal government communications and information agency, regardless of his official position, is obliged to comply only with the requirements of the legislation.
5. Employees of federal government communications and information agencies are prohibited from organizing strikes and participating in their conduct.
6. Military personnel of federal government communications and information agencies do not have the right to engage in paid off-duty activities, except for teaching, scientific and creative work.
7. Employees and workers of federal government communications and information agencies have the right to create trade unions.
8. Legislative acts of the Russian Federation on issues of labor, wages, pension provision, social and legal protection of citizens shall apply to employees and workers of federal government communications and information agencies regardless of the announcement of their entry into force by orders of the management of the Federal Agency.
9. Employees of federal government communications and information agencies performing duties related to the requirements of increased secrecy and special conditions of service (work) shall enjoy additional benefits in terms of salary (wages), calculation of length of service (work experience) and social security established by the highest state authorities of the Russian Federation.
Article 14. Responsibility of employees of federal government communications and information agencies
1. Employees of federal government communications and information agencies, when performing their official functions, act in accordance with the duties and rights established by the legislation of the Russian Federation. The actions of employees may be appealed to federal government communications and information agencies and to the court.
2. Disconnection of government and other types of special communications for the President of the Russian Federation, the Chairman of the Supreme Council of the Russian Federation and the Chairman of the Constitutional Court of the Russian Federation without their knowledge, unlawful termination of the provision of government and other types of special communications services to other users without the knowledge of persons authorized to permit the provision of these services, shall be prosecuted by law.
3. For illegal acts, employees shall bear disciplinary, administrative, criminal, and civil liability provided for by law.
Article 15. Social protection of employees of federal government communications and information agencies
1. The state guarantees social protection for employees of federal government communications and information agencies, as well as housing and pension provision in accordance with the legislation of the Russian Federation.
2. Employees of federal government communications and information agencies sent on business trips have the right to book and receive priority hotel accommodations and purchase travel documents for all types of transport in the manner determined by the Government of the Russian Federation.
3. The President of the Russian Federation, the Supreme Council of the Russian Federation and the Government of the Russian Federation may establish or extend to employees of federal government communications and information agencies other benefits and social protection measures not provided for by this Law.
Article 16. Special technical means of federal government communications and information agencies
Federal agencies of government communications and information, within the limits of their competence, develop, create and use special technical means, and also ensure their safety in order to implement the tasks assigned to them and the duties imposed on them.
The procedure for using special technical means is established by regulatory acts of the Federal Agency in agreement with the Supreme Council of the Russian Federation.
Article 17. Financial and logistical support for federal government communications and information agencies
1. Financial and logistical support for federal government communications and information agencies shall be provided from the republican budget of the Russian Federation.
2. The annual budget of federal government communications and information agencies shall be approved by the Supreme Council of the Russian Federation upon the submission of the President of the Russian Federation simultaneously with the republican budget of the Russian Federation.
The procedure for the material and technical support of federal government communications and information agencies is established by the President of the Russian Federation upon the recommendation of the Director General of the Federal Agency.
3. The Government of the Russian Federation shall determine the list of enterprises, institutions and organizations, regardless of their departmental affiliation and organizational and legal forms, which, on a priority basis within the framework of state procurement, carry out the development, production and supply of weapons, military and special equipment, and industrial and technical products for federal government communications and information agencies.
4. Financial, logistic and technical support of troops (except for communications equipment) is carried out by the supply bodies of the Ministry of Defense of the Russian Federation. Payments for the provision of troops with all types of supplies in peacetime are made centrally at the expense of the Federal Agency. In wartime, such provision is carried out in accordance with the legislation of the Russian Federation on martial law.
5. Land plots, enterprises, buildings, structures, premises, equipment and other property, as well as other objects under the jurisdiction or operational management of federal government communications and information agencies, are exclusively federal property.
Article 18. Protection of information of federal government communications and information agencies
1. Persons who are being hired for service (work) in federal government communications and information agencies, who by the nature of their work will have access to information constituting a state or other secret specially protected by law, undergo the procedure for obtaining access to the said information and are liable in accordance with the legislation of the Russian Federation for violating the procedure for preserving this information.
Employees of federal government communications and information agencies, after termination of their service (work) in these agencies, are prohibited from using, disclosing, distributing, transmitting information that has become known to them and acquired knowledge about state codes, methods of intelligence activities in the sphere of encrypted, classified and other types of special communications, containing state or other secrets specially protected by law, without permission from the Federal Agency.
2. All persons who have gained access to state codes, as well as to information about the activities of federal government communications and information agencies, constituting a state or other secret specially protected by law, are liable for violating the procedure for their preservation in accordance with the legislation of the Russian Federation.
3. Documentary materials concerning the activities of federal government communications and information agencies shall be stored in the archives of these agencies. Materials from the archives of federal government communications and information agencies that are of historical and scientific value and declassified in accordance with the legislation of the Russian Federation shall be transferred to the State Archival Service of the Russian Federation.
Article 19. Cryptographic reserve of the Federal Agency for Government Communications and Information under the President of the Russian Federation
In order to maintain the cryptographic potential of the Russian Federation at the proper level, the Director General of the Federal Agency has the right to create a cryptographic reserve from among highly qualified cryptographers who have retired or retired, as well as from among other specialists at his own discretion. Those included in the cryptographic reserve agree to return, if necessary, to work and perform duties determined by the Director General of the Federal Agency.
The Director General of the Federal Agency has the right, within the limits of the allocated appropriations, to create a special fund and determine the procedure for its use to attract specialists to the cryptographic reserve.
SECTION V
CONTROL AND SUPERVISION OF THE ACTIVITIES OF FEDERAL GOVERNMENT COMMUNICATIONS AND INFORMATION BODIES
Article 20. Presidential control
The President of the Russian Federation exercises control over the implementation of the main tasks assigned to the Federal Agency, approves programs for the development of federal government communications and information agencies, and authorizes the implementation of events by these agencies that affect the vital interests of the Russian Federation.
Article 21. Parliamentary Control
Control by the Supreme Council of the Russian Federation over the activities of federal government communications and information agencies is carried out in the form of hearing reports from the Director General of the Federal Agency, as well as reports from officials of federal government communications and information agencies in the Supreme Council of the Russian Federation.
The Supreme Council of the Russian Federation shall exercise control over the activities of federal government communications and information agencies by the Committee of the Supreme Council of the Russian Federation on Defense and Security.
People's Deputies of the Russian Federation may receive information protected by law on the activities of federal government communications and information agencies in the manner determined by the laws of the Russian Federation.
Article 22. Prosecutor's Supervision
Supervision over the implementation of laws of the Russian Federation by federal government communications and information agencies is carried out by the Prosecutor General of the Russian Federation and prosecutors subordinate to him.
Article 23. Communication of federal government communications and information agencies with the public
1. Federal government communications and information agencies inform the public about their activities through the relevant services created within these agencies.
2. Materials submitted to the mass media on the activities of federal government communications and information agencies must not contain information classified, in accordance with the legislation of the Russian Federation, as a state or other specially protected secret by law.
3. Employees of federal government communications and information agencies may speak in the mass media on issues related to the activities of these agencies only with the approval of their heads. Materials on the activities of federal government communications and information agencies prepared for publication by former employees of these agencies or with their assistance are submitted for consideration to the relevant federal government communications and information agencies for a reasoned decision on the possibility or impossibility of their publication.
