«On measures to ensure compliance with the law in the field of development, production, sale and operation of encryption tools, as well as the provision of services in the field of information encryption»

In order to ensure unconditional compliance with the Law of the Russian Federation «On federal government communications and information agencies», as well as to strengthen the fight against organized crime and improve the security of information and telecommunications systems of government agencies, Russian credit and financial institutions, enterprises and organizations, I decree:

1. Grant the Program for the Creation and Development of a Special-Purpose Information and Telecommunications System in the Interests of Government Bodies the status of a presidential program. The Center for Presidential Programs of the Administration of the President of the Russian Federation, together with the Federal Agency for Government Communications and Information under the President of the Russian Federation, shall ensure its revision and implementation.
2. Prohibit the use by government organizations and enterprises in information and telecommunications systems of encryption tools, including cryptographic means of ensuring the authenticity of information (electronic signature), and secure technical means of storing, processing and transmitting information that do not have a certificate from the Federal Agency for Government Communications and Information under the President of the Russian Federation, as well as the placement of government orders at enterprises and organizations that use the specified technical and encryption tools that do not have a certificate from the Federal Agency for Government Communications and Information under the President of the Russian Federation.
3. To propose that the Central Bank of the Russian Federation and the Federal Agency for Government Communications and Information under the President of the Russian Federation take the necessary measures with respect to commercial banks of the Russian Federation that evade the mandatory use of protected technical means of storing, processing and transmitting information that have a certificate from the Federal Agency for Government Communications and Information under the President of the Russian Federation during their information interaction with divisions of the Central Bank of the Russian Federation.
4. In the interests of the information security of the Russian Federation and strengthening the fight against organized crime, prohibit the activities of legal entities and individuals related to the development, production, sale and operation of encryption tools, as well as secure technical means of storing, processing and transmitting information, providing services in the field of information encryption, without licenses issued by the Federal Agency for Government Communications and Information under the President of the Russian Federation in accordance with the Law of the Russian Federation «On Federal Bodies of Government Communications and Information».
5. The State Customs Committee of the Russian Federation shall take measures to prevent the import of foreign-made encryption devices into the territory of the Russian Federation without a license from the Ministry of Foreign Economic Relations of the Russian Federation, issued in agreement with the Federal Agency for Government Communications and Information under the President of the Russian Federation.
6. The Federal Counterintelligence Service of the Russian Federation and the Ministry of Internal Affairs of the Russian Federation, together with the Federal Agency for Government Communications and Information under the President of the Russian Federation, the State Tax Service of the Russian Federation and the Tax Police Department of the Russian Federation, shall identify legal entities and individuals violating the requirements of this Decree.
7. To propose to the Prosecutor General's Office of the Russian Federation to strengthen prosecutorial supervision over compliance with the Law of the Russian Federation «On Federal Agencies for Government Communications and Information» in terms of the development, production, sale and operation of encryption tools, as well as the provision of services in the field of information encryption in the Russian Federation, subject to licensing and certification by the Federal Agency for Government Communications and Information under the President of the Russian Federation.
8. To create a Federal Center for the Protection of Economic Information under the Federal Agency for Government Communications and Information under the President of the Russian Federation (within the staffing levels of this Agency), assigning to it the development and implementation of comprehensive programs to ensure the security of economic information of Russian credit and financial and other economically significant structures of the country. The Director General of the Federal Agency for Government Communications and Information under the President of the Russian Federation shall approve the regulations on the said center within 2 months.
9. This Decree shall enter into force on the date of its publication.
